depresi\u00f3n?<\/a><\/li><\/ul><\/nav><\/div>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFCuales_suelen_ser_las_causas_del_trastorno_depresivo\"><\/span><strong>\u00bfCu\u00e1les suelen ser las causas del trastorno depresivo?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pueden ser diversas, pero las m\u00e1s conocidas son el estr\u00e9s, la ansiedad, conflictos laborales dentro de la empresa o problemas personales, no ser\u00e1 una sola la que lo produzca sino un compendio de casi todas.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFQuien_sera_el_facultativo_que_conceda_o_tramite_la_baja\"><\/span><strong>\u00bfQui\u00e9n ser\u00e1 el facultativo que conceda o tramite la baja?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Depende de la causa de la que provenga la depresi\u00f3n:<\/p>\n<ul>\n<li><strong>Si la baja procede de una contingencia com\u00fan<\/strong>, o sea, es considerada como una enfermedad com\u00fan, la conceder\u00e1 en m\u00e9dico de familia<\/li>\n<li><strong>Si la baja procede de una contingencia profesional<\/strong>, o sea, la depresi\u00f3n se produce por causa relacionada con su profesi\u00f3n o la empresa donde realiza su trabajo (estr\u00e9s, conflictos internos&#8230;), la conceder\u00e1 la mutua, <strong>aunque esta es dif\u00edcil de justificar,<\/strong> ya que<strong> no se considera enfermedad profesional<\/strong><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFCuanto_cobraria_el_trabajador_mientras_se_encuentra_en_situacion_de_baja_por_depresion_y_no_existe_mejora_en_el_convenio_colectivo\"><\/span><strong>\u00bfCu\u00e1nto cobrar\u00eda el trabajador mientras se encuentra en situaci\u00f3n de baja por depresi\u00f3n y no existe mejora en el convenio colectivo?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Teniendo en cuenta que el 99% se considera como enfermedad com\u00fan:<\/p>\n<ul>\n<li><strong>los 3 primeros d\u00edas<\/strong> de la baja no cobrar\u00eda<\/li>\n<li><strong>del 4 al 15 cobrar\u00eda el 60%<\/strong> de la base reguladora y lo<strong> pagar\u00eda la empresa<\/strong><\/li>\n<li><strong>16 al 20 cobra el 60%<\/strong> de la base reguladora pag\u00e1ndolo el<strong> INSS<\/strong><\/li>\n<li><strong>A partir del d\u00eda 21 cobra el 75%<\/strong> de la base reguladora y paga el <strong>INSS<\/strong><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"%C2%BFY_si_existe_mejora_en_el_convenio_colectivo\"><\/span><strong>\u00bfY si existe mejora en el convenio colectivo?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El trabajador cobrar\u00e1 el 100%, siendo la empresa la que abone la cantidad que complete el porcentaje hasta el 100% que le corresponda<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFQue_sucede_si_el_trabajador_que_tiene_la_baja_por_depresion_es_Autonomo\"><\/span><strong>\u00bfQu\u00e9 sucede si el trabajador que tiene la baja por depresi\u00f3n es Aut\u00f3nomo?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pues que <strong>cobrar\u00e1 en los mismos porcentajes que un trabajador que su contrato no tiene mejora<\/strong>, o sea, el 60% y el 75%, pero la entidad pagadora ser\u00e1 la mutua.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFCuanto_tiempo_puede_estar_de_baja_un_trabajador_por_depresion\"><\/span><strong>\u00bfCu\u00e1nto tiempo puede estar de baja un trabajador por depresi\u00f3n?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Ser\u00e1 de 365 d\u00edas, ampliables 180 d\u00edas m\u00e1s en el supuesto de posibilidad de curaci\u00f3n, en el total ser\u00eda 545 d\u00edas, as\u00ed se encuentra regulado en el art. 174 LGSS<\/p>\n<h3><span class=\"ez-toc-section\" id=\"%C2%BFExiste_la_obligacion_de_cotizar_mientras_que_un_trabajador_esta_de_baja_por_depresion\"><\/span><strong>\u00bfExiste la obligaci\u00f3n de cotizar mientras que un trabajador est\u00e1 de baja por depresi\u00f3n?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>La obligaci\u00f3n de cotizar <strong>continuar\u00e1 mientras que dure la situaci\u00f3n de incapacidad temporal<\/strong>, con independencia de la causa de la que proceda y as\u00ed lo indica el art. 144 <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11724\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">LGSS<\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFSe_puede_extinguir_un_contrato_mientras_que_el_trabajador_esta_de_baja_por_depresion\"><\/span><strong>\u00bfSe puede extinguir un contrato mientras que el trabajador est\u00e1 de baja por depresi\u00f3n?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Si es un <strong>contrato temporal<\/strong> cuya fecha de t\u00e9rmino est\u00e1 establecida con anterioridad como pueda ser un contrato por circunstancias de producci\u00f3n, el contrato finaliza en su d\u00eda y le corresponder\u00eda la indemnizaci\u00f3n correspondiente al contrato regulada en el art. 49.1.c<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"> ET<\/a>.<\/p>\n<blockquote>\n<p>Si se produce en un <strong>contrato indefinido<\/strong>, atendiendo a la causa en la que se base, <strong>le corresponder\u00e1 la indemnizaci\u00f3n correspondiente<\/strong> atendiendo al Estatuto de los
