{"id":840,"date":"2012-09-26T12:32:20","date_gmt":"2012-09-26T12:32:20","guid":{"rendered":"http:\/\/www.inesem.es\/revistadigital\/gestion-empresarial\/?p=840"},"modified":"2019-10-15T11:43:04","modified_gmt":"2019-10-15T09:43:04","slug":"permiso-por-maternidad","status":"publish","type":"post","link":"https:\/\/www.inesem.es\/revistadigital\/gestion-empresarial\/permiso-por-maternidad","title":{"rendered":"El permiso por maternidad"},"content":{"rendered":"\n<p style=\"text-align: justify;\">Con la crisis y el aumento del desempleo son muchas las parejas que se han animado a tener hijos para aprovechar el tiempo cuid\u00e1ndolos.\u00a0 Seg\u00fan el <a href=\"https:\/\/www.ine.es\/prensa\/np697.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Instituto Nacional de Estad\u00edstica<\/a> durante el primer semestre de 2011 hubo 230.537 nacimientos, un 1,1% menos que en el mismo periodo de 2010. Se ampliar\u00e1 en<strong> 2 semanas m\u00e1s por cada hijo a partir del segundo<\/strong>, si se trata de parto m\u00faltiple. Tambi\u00e9n tiene una ampliaci\u00f3n en el caso de discapacidad y de hospitalizaci\u00f3n del reci\u00e9n nacido. En supuestos de maternidad biol\u00f3gica, no cabe la reincorporaci\u00f3n de la madre al puesto de trabajo hasta que hayan transcurrido las<strong> 6 semanas posteriores al parto establecidas como descanso obligatorio.<\/strong><\/p>\n<p style=\"text-align: justify;\">El per\u00edodo de descanso restante se podr\u00e1 disfrutar en r\u00e9gimen de jornada completa o tiempo parcial previo acuerdo con el empresario.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"%C2%BFQue_cobrara_mientras_este_de_baja_maternal\"><\/span>\u00bfQu\u00e9 cobrar\u00e1 mientras este de baja maternal?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">El subsidio por maternidad se disfruta en los supuestos de maternidad, adopci\u00f3n, acogimiento y tutela de madres trabajadoras en el r\u00e9gimen general o por cuenta propia.\u00a0 El impreso lo ha de tramitar frente al Instituto Nacional de la Seguridad social. La<strong> prestaci\u00f3n ser\u00e1 del 100% de la base reguladora<\/strong> y se continuar\u00e1 cotizando y reteniendo al IRPF.<\/p>\n<p style=\"text-align: justify;\">En caso de percibir la prestaci\u00f3n a jornada parcial, se podr\u00e1 combinar con el trabajo a jornada parcial de la madre o se podr\u00e1 compartir la prestaci\u00f3n con la del padre durante las 10 semanas restantes.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"%C2%BFY_cual_es_el_periodo_minimo_de_cotizacion_necesario\"><\/span>\u00bfY cu\u00e1l es el periodo m\u00ednimo de cotizaci\u00f3n necesario?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Depende de la edad para las trabajadoras:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Menores de 21 a\u00f1os:<\/strong> no se exige periodo m\u00ednimo de cotizaci\u00f3n<\/li>\n<li><strong>Cumplidos 21 a\u00f1os y menor de 26:<\/strong> 90 d\u00edas cotizados dentro de los 7 a\u00f1os inmediatamente anteriores a la fecha del inicio del descanso o, alternativamente, 180 d\u00edas cotizados a lo largo de la vida laboral.<\/li>\n<li><strong>Mayor de 26 a\u00f1os:<\/strong> 180 d\u00edas dentro de los 7 a\u00f1os inmediatamente anteriores al momento del inicio del descanso o, alternativamente, 360 d\u00edas cotizados a lo largo de su vida laboral.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">En caso de parto de trabajadoras que re\u00fanan todos los requisitos para acceder a la prestaci\u00f3n de maternidad, excepto el per\u00edodo m\u00ednimo de cotizaci\u00f3n, tendr\u00e1n derecho a un <strong>subsidio no contributivo durante los 42 d\u00edas naturales siguientes al parto,<\/strong> en una cuant\u00eda equivalente al 100% del IPREM (Indicador p\u00fablico de renta de efectos m\u00faltiples).<\/p>\n<p style=\"text-align: justify;\">Durante el per\u00edodo de disfrute del permiso de maternidad o paternidad a tiempo parcial, los trabajadores no podr\u00e1n realizar horas extraordinarias, salvo las necesarias para prevenir o reparar siniestros y otros da\u00f1os extraordinarios y urgentes.<\/p>\n<p style=\"text-align: justify;\">Esperamos haberos ayudado a obtener toda la informaci\u00f3n posible para aumentar el n\u00famero de espa\u00f1oles futuros y de esta forma subir el % del Instituto Nacional de Estad\u00edstica.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La duraci\u00f3n del permiso por maternidad de las madres trabajadores es de 16 semanas ininterrumpidas en\u00a0 caso de parto, adopci\u00f3n o acogimiento.<\/p>\n","protected":false},"author":34,"featured_media":5067,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"class_list":["post-840","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-recursos-humanos"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.5 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>\u00bfCu\u00e1nto dura el permiso por maternidad?
