{"id":1834,"date":"2016-07-14T15:48:45","date_gmt":"2016-07-14T13:48:45","guid":{"rendered":"http:\/\/www.inesem.es\/revistadigital\/juridico\/?p=1834"},"modified":"2016-12-16T10:41:17","modified_gmt":"2016-12-16T09:41:17","slug":"mediacion-laboral","status":"publish","type":"post","link":"https:\/\/www.inesem.es\/revistadigital\/juridico\/mediacion-laboral","title":{"rendered":"La mediaci\u00f3n laboral: resoluci\u00f3n de conflictos en entornos de trabajo"},"content":{"rendered":"<p style=\"text-align: justify;\">Los conflictos son habituales en\u00a0el entorno\u00a0laboral y en cualquier organizaci\u00f3n o grupo social, esto no quiere decir que solo se desprendan connotaciones negativas del concepto, sino que se <strong>consideran momentos necesarios dentro de una empresa<\/strong> o circunstancia para confrontar ideas, creencias, valores, opiniones, etc.<\/p>\n<p style=\"text-align: justify;\">En esta l\u00ednea, afirma Escudero que: <em>\u00abel conflicto y las posiciones discrepantes pueden, y deben, generar debate y servir de base de lucha ideol\u00f3gica y articulaci\u00f3n de pr\u00e1cticas sociales y educativas liberadoras\u00bb.<\/em><\/p>\n<p style=\"text-align: justify;\">Si nos atenemos a una definici\u00f3n pr\u00e1ctica, consideramos el conflicto como una situaci\u00f3n en la que dos o m\u00e1s personas se encuentran en <strong>desacuerdo<\/strong> porque no manifiestan los mismos <strong>intereses, necesidades, deseos o valores<\/strong>, portando gran importancia los sentimientos y emociones de las partes.<\/p>\n<p style=\"text-align: justify;\">As\u00ed pues, entendemos el conflicto como una <strong>tensi\u00f3n entre las partes<\/strong> que demandan intereses diferentes, lo que genera ocasiones para proporcionar cambios necesarios para la evoluci\u00f3n de la organizaci\u00f3n y las personas que la integran. Por tanto, si nos enfocamos en el entorno de trabajo, deber\u00edamos de atenernos al <strong>conflicto laboral<\/strong>, es decir, aquel conflicto que se da en el seno de una empresa o puesto de trabajo.<\/p>\n<p style=\"text-align: justify;\">Una de las causas principales que originan los conflictos laborales es la <strong>falta de motivaci\u00f3n del trabador<\/strong> que hoy d\u00eda existe en el entorno laboral, y la incomodidad de los mismos en su puesto de trabajo; bien porque haya personalidades que no sean afines con otras o, simplemente, porque no se encuentran c\u00f3modas en el puesto.<\/p>\n<p style=\"text-align: justify;\">Y es que no debemos olvidar que un conflicto supone una <strong>alteraci\u00f3n\u00a0 emocional en el\u00a0 trabajador<\/strong> y, en definitiva, el conflicto no resuelto, conlleva consecuencias perjudiciales para el trabajador y su entorno.<\/p>\n<p style=\"text-align: justify;\">Para que tales tipos de conflictos no desemboquen en consecuencias negativas superiores surge la figura de <strong>la <a href=\"https:\/\/www.asemed.org\/\" target=\"_blank\" rel=\"nofollow\">mediaci\u00f3n<\/a>\u00a0laboral<\/strong>, la cual est\u00e1 cada vez m\u00e1s demandada para este tipo de situaciones, si bien no solo afrontan conflictos negativos, sino que tambi\u00e9n ejercen como potenciadores de los conflictos positivos que ayudan al desarrollo de los equipos de trabajo.<\/p>\n<p style=\"text-align: justify;\">La mediaci\u00f3n laboral es el proceso por el que una persona, <strong>independiente e imparcial <\/strong>\u00a0y con formaci\u00f3n suficiente, ayuda a otras a encontrar soluciones para resolver sus divergencias en el entorno de trabajo, evitando acudir a otro tipo de cauces m\u00e1s restrictivos y arbitrarios.<\/p>\n<p style=\"text-align: justify;\">En definitiva, en funci\u00f3n de c\u00f3mo se desarrollen las <strong>habilidades de la mediaci\u00f3n laboral, comunicaci\u00f3n, di\u00e1logo y capacidad <\/strong>de razonamiento, el proceso conflictivo derivar\u00e1 en consecuencias negativas o positivas. Es por eso, que la figura del mediador\u00a0encarg\u00e1ndose de proponer una soluci\u00f3n cuando las partes se encuentran en una situaci\u00f3n de conflicto, evitando acudir a la v\u00eda judicial.<\/p>\n<p style=\"text-align: justify;\">.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Los conflictos son habituales en la vida laboral y en cualquier organizaci\u00f3n.
